Penal codes of most Hispanic countries refer, directly or indirectly, to the distinction between homicidio culposo and homicidio doloso, based on dolo or criminal intent and culpa or criminal negligence. Although this distinction is somewhat similar to the murder-manslaughter duality based on the presence or absence of malice aforethought, there is no exact correspondence. Manslaughter is an unintentional homicide, that is homicidio no intencional or culposo, but it is also an intentional homicide without malice (voluntary manslaughter), that is, homicidio intencional atenuado.
